Terms of Service

Agreement

By using the Listy website, booking portal or app, you agree to be bound by these Terms of Service. Listy is operated by 1001544748 Ontario Inc., based in Ontario, Canada. If you do not agree to these terms, do not use Listy. For questions, contact us at hello@listy.live.

Who Can Use Listy

Listy is intended for anyone who needs HDR listing photos — including real estate agents, landlords, tenants, real estate photographers, and others. By creating an account, you confirm that you are at least 18 years of age.

The Service

Listy provides a workflow platform that allows real estate photographers to capture, tag, and upload property photos, coordinate editing, and deliver finished photos to clients.

Our target turnaround time for edited photo delivery is approximately 3 hours from the time of upload. This is a target, not a guarantee, and may vary based on volume and third-party processing times.

Bookings and Payment

All bookings and payments are managed through our booking system. Payment is collected at the time of booking. Listy does not collect, store, or process any payment information directly.

By placing a booking, you agree to all applicable payment policies in addition to these terms.

Cancellations

Because bookings are typically placed immediately prior to a shoot, cancellations are generally not expected or necessary. If an extraordinary circumstance requires a cancellation, please contact us directly at hello@listy.live and we will work with you on a case-by-case basis.

Listy does not guarantee refunds or cancellations outside of the extraordinary circumstances process described above.

Refunds and Credits

Listy operates as a low-cost, high-efficiency service. As such, we do not offer revisions to edited photos. If you believe there has been a significant error on our part, you may contact us at hello@listy.live to request a review.

At our sole discretion, we may issue account credits for use toward future bookings. Credits are non-transferable, have no cash value, and expire 12 months from the date of issue. We do not issue cash refunds except where required by applicable law.

Your Content

You retain ownership of all photos you capture and upload through Listy. By uploading photos through the app, you grant 1001544748 Ontario Inc. a limited, non-exclusive licence to store, transfer, and process your photos solely for the purpose of providing the Listy service.

You are responsible for ensuring you have the right to photograph the properties you submit through Listy. You must not upload any content that is illegal, infringes on the rights of others, or violates any applicable law.

Acceptable Use

You agree not to:

• Use Listy for any purpose other than legitimate real estate photography
• Attempt to reverse engineer, hack, or disrupt the Listy platform
• Share your account credentials with unauthorized individuals
• Upload content that is illegal, harmful, or violates the rights of any third party
• Use the service in any way that could damage, disable, or impair Listy's infrastructure

Violation of these terms may result in immediate suspension or termination of your account.

Limitation of Liability

To the maximum extent permitted by applicable law, 1001544748 Ontario Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of Listy, including but not limited to loss of data, loss of revenue, or dissatisfaction with edited photos.

Our total liability to you for any claim arising from your use of Listy shall not exceed the amount paid by you for the specific booking giving rise to the claim.

Account Termination

We reserve the right to suspend or terminate your account at any time if you violate these terms or engage in conduct that we determine, in our sole discretion, is harmful to Listy, our partners, or other users. You may also delete your account at any time directly in the app from the Settings screen (tap Settings, then Delete Account).

Changes to These Terms

We may update these Terms of Service from time to time. When we do, we will update the date at the top of this page. Continued use of Listy after any changes constitutes your acceptance of the updated terms. For significant changes, we will notify you by email.

Governing Law

These Terms of Service are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these terms or your use of Listy shall be subject to the exclusive jurisdiction of the courts of Ontario.
